A. If he hasn't been in any other trouble, he can try to have his felony reduced to a misdemeanor and then have it expunged. We do that sometimes in our courts, here in CA. He's have to go back to Court, in the county where he was on probation, and request this. He can contact the Probation Department for that county... talk to his former probation officer... and find out what the rules are on getting the record expunged. It'll require that he did everything he was supposed to do while on probation, including paying the fines/fees... and that a certain amount of time has passed since probation terminated... with no new offenses. A. If you have a felony conviction you automatically lose your medical license in most states. You also cannot apply for a medical license with a felony conviction on your record. In many states, the nature of the misdemeanor will determine whether you can get a medical license. For example, if you have a misdemeanor conviction for illegal trafficking of prescription drugs you probably won't be able to get a license. On the other hand, a misdemeanor conviction for smoking in a public place probably wouldn't cause a problem. A. Two things will happen. One, the other county has listed your warrant on the State records system and possibly with NCIC, a national data base. Any routine query by an officer will bring up the warrant information. So, the first time you get pulled over for a traffic violation, you get busted for the warrant. Two, someone in the other county will rat you out eventually and you will be arrested at your home or new job. Get yourself a lawyer and try to arrange something with the other county or just turn yourself in.

A. I am not sure about FL, but yes this can be done. If you fall under a statute of Criminal Habitual Offender then there can be increased penalties. In Wisconsin 1 felony conviction or 3 misdemeanors charges makes you a habitual offender and all charges after that are considered felony and increases the penalties 3 times. Say a 1 year maximum jail term will be increased to 3 years.

It could be charged as a felony if he was in the past convicted and committed to a penal institution (jail or prison) for a theft or fraud offense (Pen C 666 requires such custody in addition to a conviction). Additionally, the prosecutor is not limited in filing to the charge for which the police officer made an arrest, so this might be a grand theft or burglary charge now.
